Preconditions for Adopting the New Regulation

The sphere of agent activity has long required clearer, unified, and transparent regulatory rules. The main challenges were:

— Implementing uniform standards for representation agreements to protect players/coaches/clubs' interests when signing such agreements;

— Preventing conflicts of interest during the provision of agent services;

— Prohibiting individuals without FIFA agent licenses from engaging in agency activities within UAF jurisdiction;

— Ensuring prohibition of opaque payments to agents and implementing reporting mechanisms;

— Absence of uniform registration standards for agents with UAF;

— Lack of monitoring and registration of representation agreements ("agency agreements");

These issues formed the basis for developing the new Regulation.

Main Objectives of the Regulation

The Regulation is aimed at achieving several strategic objectives.

First, enhancing transparency in agent activity through:

— Implementation of registration procedures for agents and agencies;

— Setting criteria and special conditions for providing services to minors;

— Implementing reporting procedures for agents regarding signed representation agreements, other contracts;

— Implementing reporting procedures during the provision of services by an agent;

— Implementing reporting procedures on agent remuneration.

Second, ensuring client rights and legal interests protection through clearly defined standards for representation agreements and the possibility to terminate such agreements unilaterally due to serious reasons (as defined by the Regulation).

Third, minimizing conflicts of interest during service provision and preventing abuse, price hikes, and speculative activities via:

— Defining a circle of subjects an agent may provide services to in one transaction;

— Establishing the principle of fairness when terminating representation agreements;

— Setting the size of the agent's remuneration for provided services;

— Requiring agents to report to clients and UAF regarding provided services and received remuneration;

— Prohibiting an agent from receiving any transfer compensation or preparation fee that is payable in connection with a player's transfer, directly or indirectly involving the player in a bridge-transfer, or acquiring any rights related to the registration of a player and circumventing limits set by this Regulation.

Fourth, unifying agent activity rules within UAF jurisdiction to FIFA requirements via:

— Registration of agents with UAF;

— Registration of representation agreements and other service contracts;

— Obtaining and verifying reporting documents related to the agent's activities.
